Welcome to FitNoggin. These Terms of Service ("Terms") govern your access to and use of the FitNoggin website located at fitnoggin.com and all services offered through it. By accessing or using the website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the website or services.

2. Nature of Services
FitNoggin teaches adults over 40 to read their body composition scans and eat to keep their lean mass, through a free calculator and self-paced courses and guides.
FitNoggin sells education and digital products only. These are the free Body Comp TDEE Calculator, the free guide "Reading Your First Scan," The Lean Mass Course at $149 as a one-time purchase, and standalone guides at $24 each.
FitNoggin does not provide personal coaching, meal plans, supplements, or medical care of any kind. Courses and guides are self-paced and are not tailored to any one person.
"FitNoggin Academy" is a brand name for our library of courses and guides. It is not a school, and it is not accredited. Completing a course or guide does not earn a certification, a license, or continuing education credits.
3. Educational Content, Not Medical Advice
Everything on this website, including calculator results, courses, and guides, is for general education. Calculator results are educational estimates based on the numbers you enter and published formulas. They are not a measurement of your body.
Nothing FitNoggin provides is a diagnosis, treatment, or personal coaching, and it does not replace advice from a doctor or other qualified health professional. Talk to a doctor before you make a major change to your diet or exercise, especially if you have a health condition or take medication.
FitNoggin does not promise any weight loss, change in body composition, or other health outcome. Results depend on many things outside our control.
4. The Calculator
The Body Comp TDEE Calculator is free to use and needs no account. It runs in your browser. The numbers you enter are not sent to FitNoggin or stored by us.
Its results are estimates. Your actual resting burn and daily energy use may differ from what the calculator shows, including from values measured in a lab or clinic.
5. Purchases and Access
Courses and guides are sold at the one-time price shown before you order. There is no subscription and no recurring charge.
When you buy a course or guide, you get lifetime access to that course or guide for your own personal use. You may not share your login, resell the materials, or copy, post, or distribute them to anyone else.

6. Intellectual Property
All content on the FitNoggin website, including text, graphics, logos, icons, images, and software, is the property of FitNoggin or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from this website without prior written consent from FitNoggin.
The FitNoggin name and logo are trademarks of FitNoggin. Nothing on this website grants any license or right to use any trademark without the prior written permission of FitNoggin.
7. SMS Messaging – Marketing Messages
By opting in to the FitNoggin Text Club program, you give your express consent to receive recurring automated marketing text messages from FitNoggin at the mobile number you provide. These messages may include new courses and guides, enrollment openings, sales on FitNoggin products, and new free tools. Messages come from FitNoggin only; we do not send third-party offers by SMS. Consent to receive marketing text messages is not a condition of purchase or of using FitNoggin.
Message frequency: Up to 4 msgs/month. Message and data rates may apply. Reply STOP to cancel, HELP for help.
You may opt out of receiving SMS messages at any time by replying STOP to [INSERT SHORT CODE]. Upon receipt of your STOP message, you will be removed from all future SMS communications. Carriers are not liable for delayed or undelivered messages. FitNoggin does not charge for SMS messages, but your carrier's standard messaging rates may apply.
8. Disclaimer of Warranties
The FitNoggin website and all services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. FitNoggin does not warrant that the website will be uninterrupted, error-free, or free from viruses or other harmful components, and makes no warranties regarding the accuracy, reliability, or completeness of any content on the website.
To the fullest extent permitted by law, FitNoggin disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by applicable law, FitNoggin, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or in connection with your use of the website or services, whether based on warranty, contract, tort, or any other legal theory.
In no event shall FitNoggin's total liability to you for all claims arising out of or relating to the website or services exceed the total amount paid by you to FitNoggin during the twelve (12) months preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of the website or services shall be resolved exclusively in the state or federal courts located in Wyoming.

FitNoggin reserves the right to modify or update these Terms at any time. Changes will be posted on this page, and your continued use of the website or services after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
